Customized benchmarks related to the representation of employees within the (Supervisory) Board as the case may be

With the Cofisem database, it is now possible to create your customized benchmarks related to the representation of employees within the (Supervisory) Board, whether it is the presence of employee shareholders’ representatives or employees’ delegates, as stated in the law on the protection of employment (Decision no 2013-672 DC) of June 14th 2013.

Indeed, the French law of June 14th 2013 on the protection of employment envisages the right of participation for employee representation, with voting rights, on the (Supervisory) Board of big corporates.

Are concerned:

  • Companies which have a registered office located in France and employ at least 5,000 permanent salaried employees in France.
  • Companies which have a registered office located in France or elsewhere, which must set up a works’ council and employ at least 10,000 permanent employees throughout the world.

Companies that have more than 12 directors must provide with at least 2 employees’ representatives, only one is needed in other cases. The objective: encourage the consideration of the employee’s point of view on their company’s business strategy.

The French government will be requested to submit to the parliament by June 30th 2015, a report tacking stock the implementation of the law and providing recommendations on the scope of application.
